The 25% cap (ended)

Home leases renewed between June 2022 and July 2024 were capped at 25% by a temporary rule. Workplaces still followed the 12-month average CPI. The rule ended on 1 July 2024.

The rules

For homes and roofed workplaces, the increase at renewal may not exceed the 12-month average CPI change of the previous lease year (Turkish Code of Obligations art. 344/1). In practice the figure for the month before the renewal month applies: a lease renewing in October uses September data, published in early October. After five years a court may set a market-based rent (rent determination case, art. 344/3), so the cap is not the whole story. A temporary 25 % cap applied to homes between 11 June 2022 and 1 July 2024.

Once a lease has run for five years, either side can file a rent determination case (kira tespit davası). The court may then set a new rent based on comparable market rents, so the cap is not the whole story.

Frequently asked questions

›Why isn't the rent cap the annual inflation rate?

Under Article 344 of the Turkish Code of Obligations, a rent increase may not exceed the change in CPI by 12-month averages over the previous lease year. This differs from headline annual inflation: it usually stays higher while inflation slows and lower while it speeds up.

›Which month's figure should I use?

Use the data for the month before your lease renews. For a lease renewing in October, the September figure published in early October applies. The table on this page shows the renewal month and the data month side by side.

›Is the rent increase capped at 25%?

No. The 25% cap on home rents was temporary and ended on 1 July 2024. Home leases renewed after that date also follow the 12-month average CPI.

›Is it the same for workplace rents?

Yes. Homes and covered workplaces share the same ceiling: the 12-month average CPI change. Workplaces followed this figure during the 25% period as well.
